ACCEPTANCE OF THE CONDITIONS
Through this Web site, Consorzio Portofino Coast places at the User’s disposal information, documents, photographs and images (hereafter called “Material”) and various services (hereafter called “Services”), subject to the terms and conditions set forth in this document (the “Conditions for Use”). By accessing this Site, the User agrees to accept these Conditions of Use. Consorzio Portofino Coast reserves the right to modify the Conditions of Use at its sole discretion. Use of the Site shall be regulated by the most recent version of the Conditions of Use published on the Site at the moment of use. When using certain Services or Material on the Site the User shall furthermore be subject to the guidelines and rules applied to such Services or Material. These may be subject to additional terms and conditions with respect to the Conditions of Use. All the guidelines and rules refer to the Conditions of Use. In the event the Conditions of Use are not respected, the right to access the Site shall be revoked and any Material downloaded or printed shall be immediately destroyed.
COPYRIGHT - LIMITED LICENSE
The Material and Services offered on the Site are protected by copyright and/or other laws regarding intellectual property. Unauthorized use of Material and Services constitutes a violation of said laws. Unless expressly indicated in this document, Consorzio Portofino Coast and its suppliers do not grant an explicit or implicit right deriving from licenses, copyrights, trademarks or confidential information relating to the Material and Services. Unless explicitly allowed by this document, no information or documents contained in the Site may be reproduced in any form or by any media without previous written consent by Consorzio Portofino Coast.
Use of information contained in the Site. Unless expressly indicated otherwise in another section of the Site, the User may view, download and print documents and information available on the Site in compliance with the following conditions:
1. Documents and information are intended exclusively for personal, non-commercial, internal use, of an informative nature.
2. Documents and information may not be changed or altered in any way.
3. Documents and information contained in the Site may not be distributed.
4. The elimination of information regarding the copyright or right to possess the contents of the documents or information is illicit.
5. Consorzio Portofino Coast reserves the right to revoke the authorization to view, download and print documents and information contained on the Site at any time. Following receipt of written notice given by Consorzio Portofino Coast, all use must cease immediately.
6. The User’s rights constitute a license for use and not for the transfer of ownership. The above mentioned right to view, download and print documents and information contained in the Site are not extended to the design or layout of the Site. Elements which make up the Site are protected by trademark and other laws and may not be copied or reproduced as a whole or in any part.
USE AND PROTECTION OF THE ACCOUNT NUMBER AND PASSWORD
The User shall be responsible for respecting the secrecy of the account number and/or password, where applicable. The User shall be held responsible for any use of the account, whether or not it is specifically authorized by the User.
GUARANTEES AND REFUSAL OF LIABILITY
Unless expressly indicated by written agreement between the User and Consorzio Portofino Coast or in conformity with current laws, all Material and Services in the Site are provided “as is” without any guarantee whatsoever, whether implied or expressed, which include but are not limited to implicit guarantees for the sale or suitability for a specific purpose or the guarantee of non –violation. Without limiting the above, Consorzio Portofino Coast does not provide any guarantee that the Services and Material offered will satisfy the User’s requirements, or that the Services and Material are not subject to interruption, are appropriate, safe or free from errors, or that the results which may be obtained through the use of Services and Material are effective, exact or reliable, that the quality of each product, or that the service or information acquired or obtained through the Site will satisfy the expectations of the User. The Site may contain technical or other errors, incorrect information, typographical errors. Consorzio Portofino Coast may change the Material and Services, including the prices and descriptions of the products and services listed, at any time and without advance notice. Material and Services on the Site may not be up to date. Consorzio Portofino Coast is not under the obligation to update said Material or Services.
Consorzio Portofino Coast does not assume any responsibility for errors or omissions in the information, documents, material or services referred to or suggested. References to companies, services and products are provided “as is” with no explicit or implied guarantee or any type.
Under no circumstances shall Consorzio Portofino Coast or its suppliers be held liable by the User or other parties for exceptional occurrences, accidents or damages directly or indirectly caused or any damage of any other nature including, without limitation, those resulting in the loss of function, of data or profits, whether or not Consorzio Portofino Coast is aware of the possibility of said damages. No responsibility is assumed deriving from or connected with the use of the Site or of any Site referred to or suggested. Under some jurisdictions the exclusion or limitation of liability for damages deriving directly or accidentally produced are prohibited. In such case the above limitation may not be applicable to the User.
The downloading or acquisition of Material from the Site is performed at the sole discretion and risk of the User. The User alone shall be held liable for any damages to the operating system or for the loss of data that may result pursuant to the downloading or acquisition of any type of material.
No notice or information, verbal or written, received from the User by Consorzio Portofino Coast though the Site shall constitute a guarantee unless expressly set forth in the Conditions of Use.
The Site contains links to Third Party Web Sites that are not controlled by Consorzio Portofino Coast. Consorzio Portofino Coast does not assume any responsibility in relation to other Sites which may be accessed through this Site. When accessing a non-Consorzio Portofino Coast Site, the User does so at his/her own risk and Consorzio Portofino Coast shall not be held responsible for the accuracy or reliability of the information, data, opinions, notices or statements present in the Sites or for the quality of the products and services offered by those same Sites. Consorzio Portofino Coast provides said links for the sole purpose of convenience and the insertion of said links does not imply in any way that Consorzio Portofino Coast shares or accepts responsibility for the contents or any use that may be made of said Sites.

USERS’ FORUM - PROHIBITED COMMUNICATION
Consorzio Portofino Coast may, but is not held to, monitor or exercise control over those areas of the Site in which Users transmit or publish information or communicate exclusively between themselves, including but not limited to, chat rooms, billboards or forums and the contents of said communication. Consorzio Portofino Coast does not assume any responsibility in connection with the contents of said communication whether or not they fall under the laws relating to copyright, privacy, libel, slander, indecency or other. Consorzio Portofino Coast furthermore rejects any liability for the misuse, loss, alteration or non-availability of the material placed on the Site by the Users. In addition to said Conditions of Use, the Users of the Consorzio Portofino Coast Forum must accept the legally binding terms of agreement contained in the User Registration Area.
It is prohibited to place or transmit on or from the Site material which is illegal, damaging, defamatory, slanderous, obscene, pornographic or which violates the law, including, with no limits, laws governing the violation of copyright. The violation of said regulations will result in exclusion from the Users’ Forum.
INDEMNITY
The User agrees to indemnify Consorzio Portofino Coast and the related companies, affiliates, representative, agents and any others sharing the trademark or other partners, including employees, and to free them from any complaint or request, including reasonable legal expenses sustained by Third Parties and derived, directly or indirectly, from the contents sent, deposited or transmitted by the User through the Site, by the use of the Site, by the connection to the Site, by the violation of the Conditions of Use or the violation of any type of right of physical persons or legal entities.
LAWS AND JURISDICTION
The Site (with the exclusion of the Sites it refers to) is controlled by Consorzio Portofino Coast. By entering in said Site, the User and Consorzio Portofino Coast accept that everything regarding your access or use of the Site in question is subject to the control of the current statutes and laws of Italy. Any controversy that may arise in relation to the Conditions of Use shall be heard before the court having jurisdiction in Italy. Consorzio Portofino Coast does not insure that the material contained in the Site is suitable or usable in other geographical areas and prohibits access in those territories in which the material contained therein may be illegal. Users who choose to access the Site from other places will do so under their own initiative and shall be responsible for any problems with local authorities which may result from such access.
TRADEMARK INFORMATION
The trademarks, logos, and marks (hereafter called “Marks”) which appear in the Site are the property of Consorzio Portofino Coast or of other Third Parties.
